State Attorney General's Office Clears Beachwood Officer In High Velocity Shooting

Case is now considered closed, Ocean County Prosecutor Marlene Lynch Ford says

The state Attorney General's Office has concluded that Beachwood Sgt. Bruce Harris used justifiable force when he shot Mark Tanouye once in the chest on the night of July 19, in the parking lot of the High Velocity Sports Bar in Beachwood.

"In a letter dated December 18, 2012, Stephen J. Taylor, the Director of the Division of Criminal Justice within the Office of the Attorney General, informed me that after their independent review of the investigation concurred with my determination that the use of deadly force was justified,” said Ocean County Prosecutor Marlene Lynch Ford said.

Ford's investigation into the shooting previously concluded that Harris had acted properly. The matter was then sent to the state Attorney General's Office for an independent review, she said

“This brings this matter to its conclusion," Ford said. "No police officer looks forward to the day when they have to make a decision that might result in the loss of life.  However, the evidence we reviewed is quite convincing.  The police officer involved, Sgt. Bruce Harris, acted with unquestioned justification in exercising lethal force under the circumstances.” .

Harris was on duty in a marked police cruiser at 10:50 p.m. on July 19 when he responded to a 10:50 p.m. call about a man "creating a disturbance" in the parking lot of the sports bar on Route 166, Executive Assistant Prosecutor Michel A. Paulhus has said.

Harris got out of his patrol car and confronted Tanouye in the sports bar parking lot. Tanouye was carrying a .25 caliber handgun, Paulhus has said.

"He ignored repeated commands to drop his weapon," Paulhus has said. "The officer discharged his weapon and the male suffered fatal injuries."

Tanouye was pronounced dead at the scene. An autopsy later determined he died of a single gunshot would to the chest.

Tanouye had a blood alcohol level of 0.092 at the time of the shooting. The state's legal limit is 0.08, Paulhus has said.

A firearm is lethal force, you can't go and shoot someone in the arm or leg! Center mass! You should be complimenting his accuracy, not criticizing his decision, which was ruled justified by professionals.

Not if he was a convicted felon. And if he did have the gun legally you can not carry in n.j. without a (conceal carry) permit. Which is next to impossible to obtain.

After reading so many of these ridiculous comments, I now understand how Obama got re-elected, despite his past record.. My only hope is that those mindless fools, realize years later, the mess they left their children in. Thankfully the officer nor any other innocent persons were'nt injured.

No Steve that's what the cops are for and I don't have dreams at night about about killing people just like to know that I have my guns at home if the day ever comes that I need one. at the end of the day its just a really expensive hobby that I enjoy. And for the second part of your asinine statement if said "responsible gun owner" gave a gun to a convict that would make said gun owner a criminal himself and no longer responsible. I also fell that any gun owner that doesn't properly secure their guns irresponsible and should face stiff punishment. But at this point that's not the case so if he stole the gun then he got what he had coming to him. You dont point a gun at a police office he or she will kill you! just saying. But by all means please keep going i find the rambo, teabagger, and right wing extremist comments funny!

Again with you Steve! I can see that you will be my entertainment today thank you as its just way too cold to throw on my camo boxers and combat boots to head over to the range! So lets start by saying I'm no fan of Bush or to tell you the truth any career politician they are all self serving and don't give a hoot about any of us. oboma has not and will not do a thing for the working people of this country. Also I would like to better understand you are we now blaming natural disasters on the republican party? If so I'm scared how far does their power reach even mother nature is taking her marching orders from them now! I have been to the shore and under a republican run state the rebuilding has begun but this will be a slow process infrastructure has to be secured and made safe before anything else can begin. Steve Really now how would digging up a dead body help, you're just sick! we can't go back but holding a gun owner accountable going forward is something that I do agree with, look I don't like in a cave, I much prefer the modern conveniences of my middle-class home. But no maker what you do criminals will get guns if they want them.Yes those kids had rights but unfortunately those rights were infringed on by a criminal. Would you suggest that we outlaw cars since drunk driver use them to kill people? We don't NEED them people got around before cars. and yes you can hunt with an AR-15 it goes a great job in the woods of that's what you chose to do with it. at the end of the day most AR-15 shot a .223 or 5.56mm round (they are the same size one is standard the other is metric) .223 is a small animal hunting round you could use it for deer but would be a little harder. An AR is kinda the same as taking a Honda Civic and putting all those stupid parts on it to make it look cool at the end of the day its still a Honda! And last but not least I won't be joining any militia just not really my thing but thanks for asking. I'll just stick with running around in my camo boxers having wet dreams! can I add that a also like combat boots! without laces of course!

Tanouye was a career career criminal. Sgt Harris did what any officer dreads doing. If the article is correct he probably gave him more warning than was wise.

The real shame is that it took so long for this matter to be resolved. This incident was pretty straight forward but this Officer was forced to wait this conclusion out for 6 months. As for some of the other lame comments, it's clear we have a division in our society. Those who support crime and those who confront it. I knew both of the men involved here. This matter came to it's proper conclusion.
