Bloodwork Results On Freeholder Involved In Fatal Accident Not Back Yet

State police have said it could take between 6 to 8 weeks for toxicological results

New Jersey State Police are still waiting for the results of bloodwork done on Freeholder John P. Kelly, after a that killed 24-year-old Barnegat motorcyclist and involved Kelly.

Trooper Christopher Kaye confirmed today that the test results are still unavailable.

"It's just a matter of waiting for them to come back," he said.

State Police have previously said it can take six to 8 weeks for toxicological tests to be completed, Polite said.

Kelly consented to the procedure, which is standard protocol in fatal accidents, state police have said.

Kolb was thrown from his motorcycle after it collided with the SUV driven by Kelly, state police have said.

Trooper Joseph Mezzo has said that Kolb was southbound on Route 9 on his black 2011 Harley Davidson at approximately 6:35 p.m. May 18, near mile marker 65.5. Kolb attempted to pass the vehicle in front of him, then collided with the right fender of Kelly's 2005 SUV when he tried to return to the lane of traffic, he said.

Kelly, 61, West Creek, was northbound on Route 9 and was attempting to make a left turn into the West Creek Deli when the collision occurred, Mezzo said.

The Ocean County Prosecutor's Office is not involved in the investigation, Executive Assistant Prosecutor Michael Paulhus has said.

No charges have been filed.

I have to agree with you. Notice there wasn't an explanation on why the results aren't available yet. I bet the Freeholders attorney knows the results.

May 9, 2012, Essex Count Judge C.A. Murray announced that
the Essex County Jury indicted Mr. A. Nunez 20, for first-degree aggravated manslaughter, second degree vehicular homicide, second degree assault plus 4th degree aggravated assault by automobile in the death of A. Nelson. Nunez the driver was driving when his auto hit a utility pole and the young woman passenger was thrown from the rear window, suffered massive severe head injuries and bodily trauma and other injuries ... the incident occurred in West Orange, Essex County on September 2010 ... something to think about regarding THIS incident and who's involved with what??? Cannot see how a test result can take this long ... look up "contravene"???

In fairness to all involved the results. Could OC ans should have been in by now. Shame on the State Police, Colonel Fuentes, the hospital and the Governor for letting such a high profile case co on so long. Something smells of incompetence here, one way or the other.

The results take time. Don't second guess the justice system. Don't you think Jack would have stepped down by now if he was drinking? He was sober until judged otherwise. He is a good man who doesn't drink.

IF Kelly is innocent of any wrong doing with drugs or alcohol HE HIMSELF should be using his clout and pressing for the results and clear any speculation. Sometimes a wound heals in time and goes away, and sometimes it festers, and develops into something worse. Sure doesn't look right!

"State Police have previously said it can take 6 to 8 weeks for toxicological tests to be completed" - It's been 6 weeks and 4 days since the accident & unfortunately this has not been the only fatal accident in the state in the last 6 weeks. Testing for alcohol AND drugs is standard when there is a fatality. The Patch has been doing a good job of keeping this accident in the headlines. Sometimes 6 to 8 weeks means just that, 6 TO 8 weeks.

So BeachGirl, you don't think Kelly could / would / should push for faster results, being he is a Freeholder? So Retired NJSP lab tech is not who he says he is or is wrong? And The Patch ( the media ) would be given such a time frame in this particular case? And Trooper Christopher Kaye would be a spokesperson to the media in this case?....only questions, but again if I were Kelly being a Freeholder, I would have had this resolved.

I know Mr Kelly and I have never seen him drink. Let's give it another two weeks. I do agree that this case should have been given a priority for the sake of those involved and for the public (due to the fact he is a public office holder). The NJSP should have done a better job in getting this over and done with. The delay only hurts their credibility.

I was at LabCorp with my son last Friday for his blood work. On Monday morning I received a call from his doctor saying his lab work came in and everything was perfect...just saying.

While I know neither party....and by what I am reading here... OMG you people are unbelievable! WHY are you all so quick to hang a man JUST bc he holds a public office? Really ? What if Kelly was just another Joe Shmoe ? Would you STILL be so quick to hang him ?
And Retired NJSP Lab Tech.... nothing like throwing unnecessary fuel on the fire! And Fedup....Be alittle be smarter...I'm sure testing for a CBC and Cholesterol is a tad bit less invasive then what the lab is testing for in regards to this accident. I'm also sure that they are gathering alot of info other then the lab work to make a intelligent decision. You all act like this is the ONLY case the State police have to solve... do you have any idea how big this state is and hw many accidents there are ALL over the state ? Jeeeze Louise people...its clearly the impatience that you show here that most likely got that biker killed, if you read the article the right way.... he tried to PASS on the RIGHT then saw he couldn't and tried to get back in his lane...IF HE only just drove like he should have and not tried to pass.... who knows it could have ended differently.? I fail to see how Kelly's toxicological tests should affect the outcome of this traffic fatality investigation regardless of what they were. Whether Kelly was traveling, sitting, or turning across the SB lane, the motorcycle driver passed another vehicle in the face of oncoming traffic (which was Kelly.) This tragic event was the result of an unfortunate error in judgment by the motorcycle driver. May he rest in peace.

If he were just a regular "Joe Shmoe" the results of the test would have been disclosed quite some time ago, that is the difference.

If he was intoxicated, his reflexs would be much slower. Not to mention he shouldn't have been in that position driving a car, to begin with. Maybe he had his directional on indicating he was making a right turn, maybe a lot of things. Maybe he did nothing to cause the accident at all. If he was driving drunk, then he's wrong regardless for being there.

Shouldn't have been in what position? Turning into the deli/liquor store parking lot. If it was unsafe, why didn't the car the bike was passing hit Kelly regardless of any possible signal? From the information published, I suspect the car being passed by the bike was preparing to turn into the parking lot also. No matter what, there wasn’t enough room to pass, especially safely. If Kelly showed any signs of being impaired, the state police would have charged him with such. Putting a political spin on standard procedures playing out is nothing more than a spiteful fishing expedition that tarnishes the tragedy itself.

I don't believe that Kelly has any influence over how quickly the lab processes the results & even if he were to it could be construed as interfering with the investigation. Trooper Kaye is usually the spokesperson for the NJSP for this area & the typical turnaround time is 6 to 8 weeks. However, in another recent fatality in the area, the tox results took almost 12 weeks. I cannot speak for Retired NJSP lab tech, but I am going to assume, that the lab, like everyone else in this state for the past few years, has felt the crunch - be it layoffs, retirements without replacements or just doing more with less. I am willing to give them the benefit of the doubt. I think, just by the comments that have been posted on all these articles, Kelly is damned if does & damned if he doesn't in the public's opinion. I still believe in innocent til proven guilty - even for politicians lol

as a family friend,there is no cover up. the entire family is overwhelmed with grief from this tragic accident. Kelly was not drinking he willingly went to soch to take the alcohol test, i cant wait for the results to come in so all can see there is no "cover up" nor can he get faster results because he holds a public office. people are so quick to judge..shame on you's.

Have an even better story my 16 year old son was killed and in auto accident in Dutchess County Ny No Sobriety test or chem test done on driver and drug paraphenalia found in river where my son drowned cause couldnt get out of seatbelt. No probable cause is the answer Sheriff,s dept is giving me!

Why couldn't you just write a classy speech, you chose to look like a sore loser once again. You stood right outside the doors and tried to talk to voters also, you did this at all the polling places.
