Get the Candy on Standby - Trick or Treat is Tonight

It will be chilly going for trick or treaters in Berkeley today and tonight. Temperatures will be in the mid-40s today and are expected to dip to around 29 this evening. Skies will be clear.

Berkeley Township has an longstanding ordinance in place that sets limits on the hours ghosts and goblins can collect their booty and also estabishes a curfew.

4-7.3    Halloween Curfew.
It shall be unlawful for any person to solicit any gifts or treats from any of the residents or business establishments of the Township after 10:00 p.m. on the day commonly known as Halloween or on such occasions known or referred to as trick-or-treat or mischief nights. (1974 Code § 90-1)

4-7.4    Parental Responsibility on Halloween Night.
It shall be unlawful for any parent or legal guardian of any child under the age of eighteen (18) to allow or permit such child to solicit any gifts or treats from any of the residents or business establishments of the Township after 10:00 p.m. on the day commonly known as Halloween or on such occasions known or referred to as trick-or-treat or mischief nights, or permit to be or remain upon any street, alley or other public or quasi-public place in the Township. (1974 Code § 90-2)

4-7.5    Parental Responsibility to Enforce Curfew.
It shall be unlawful for any parent or guardian to permit, suffer or allow any juvenile in his or her care to be in any public place between the hours of 10:00 p.m. and 6:00 a.m. (1974 Code § 90-4)

4-7.6    Responsibility of Police Force.
Every member of the Police Force while on duty is hereby authorized to detain any such minor willfully violating the provisions of this section until the parent or guardian of the child shall take him into custody; but such officer shall immediately, upon taking custody of the child, communicate with the parent or guardian.
