COAH tax on sandy rebuilds?!

So very close to getting permits on our Modular home, but told we need to pay Council of Affordable housing tax to Berkeley Twp.. This is just one more fee that should not be charged. Has anyone else encountered this? According tho the state website it is not allowed to charge fees for disaster rebuilds. http://www.state.nj.us/dca/news/news/2008/approved/080922b.html   the law for exemption is  5:97-2.5 a 1 v. How is it that Berkeley is still charging this? Bad enough to have to pay for a variance, but this seems wrong! Any ideas?
