Federal Grand Jury Indicts Bayville Man On Child Pornography Charges

Dwayne Tucker possessed and distributed images, video of 'very young children,' U.S Attorney says

A federal grand jury has indicted a Bayville man for sending "hundreds" of images and videos of child pornography online, the U.S. Attorney's Office said today.

Dwayne Tucker, 26, is charged with 28 counts of distribution of child pornography and one count of possession of child pornography, U.S. Attorney Paul J. Fishman said.

Tucker was previously charged with possession of child pornography in December 2010 and has been in jail since then. He will be arraigned on the new charges in Trenton federal court on a date to be determined.

Law enforcement officials say that Tucker sent hundreds of images and videos of child pornography to online contacts and through links during online chats, between June 2010 and November 2010. He also shared child pornography with others on a peer-to-peer network, through an Internet-based file sharing program, according to the U.S Attorney's Office.

Authorities also found a thumb drive in a jacket pocket when they searched Tucker's bedroom with pictures of prepubescent children performing sex acts on adults, authorities said.

Tucker faces a mandatory minimum penalty of five years in prison and a maximum of 20 years for each of the 28 distribution of child pornography charges. The possession of child pornography charge carries a maximum of 10 years in prison. Each charge also carries a $250,000 maximum fine.

Fishman credited special agents of the Department of Homeland Security, Immigration and Customs Enforcement, Homeland Security Investigations, under the direction of Acting Special Agent in Charge Andrew M. McLees, as well as officers of the Berkeley Township Police Department, with the investigation.

Did he make these pictures? If he did, do not let him out of jail! If not, go after the ones who did, and don't let them out either! Most of the time, it's the same people who do it again and again. Were are our rights? Once someone does this, they forfeit their rights forever! We demand protection under the constitution, or give the job to someone else.
