Ocean County Prosecutor's Office Says Beachwood Cop Took 'Appropriate Action' In Fatal Shooting

Ocean County Prosecutor Marlene Lynch Ford has determined that Beachwood Police Sgt. Bruce Harris took appropriate action when he shot and killed Mark Tanouye in the parking lot of the High Velocity Sports Bar in July, Senior Assistant Prosecutor Michel A. Paulhus said.
"It appears it's a lawful and appropriate use of deadly force," Paulhus said today. "The investigation is by no means over. But at this stage, the prosecutor has determined it to be an appropriate use of deadly force."
The Prosecutor's Office is preparing the results of the investigation to send to the state Attorney General's Office for review and a final determination on the incident, Paulhus said.
"These are just the normal steps in this type of process," he said. "We are in the process of putting it together and that will be made very soon."
Harris has had his service revolver returned to him, Paulhus said.
It will be up to Beachwood Police Chief William L. Cairns to determine when he will return to active duty, he said.
Harris was in uniform in a marked police cruiser on July 19 when he responded to a 10:50 p.m. call about a man "creating a disturbance" in the parking lot of the sports bar on Route 166, Paulhus has said.
Harris got out of his patrol car and confronted Tanouye in the sports bar parking lot. Tanouye was carrying a .25 caliber handgun, Paulhus has said.
"He ignored repeated commands to drop his weapon," Paulhus has said. "The officer discharged his weapon and the male suffered fatal injuries."
Tanouye was pronounced dead at the scene. An autopsy determined he died of a single gunshot would to the chest.
Harris was put on administrative leave while the investigation continues, which is standard procedure, Ford has said.
The results of Tanouye's blood alcohol levels at the time of the shooting are not yet available, Paulhus said today.
"It's normally six to eight weeks," he said.
Tanouye had a lengthy criminal record. He was last admitted to state prison in March 2008 and was released March 2012 from South Woods State Prison, on one count of terroristic threats to kill, and one count of weapons possession for an unlawful purpose. The charges stemmed from an incident in May 14, 2006, according to the state Departments of Corrections website.
On May 5 of that year, Tanouye impersonated a public servant, a charge which he also served prison time for. He used aliases such as Gregory Bartholomew, Bartholemew Dangalow, Mark Dangelo and Mark Tonouge, according to the DOC website.

no where in this artical did it say he had his gun drawn on the cop, it just said he was carrying one. now was it really nessasary for this cop to kill him. where was his zapper or mace. he could have shot him in the leg, shoulder or some where else enough to stun him long enough to get his gun. no the cop took the cowards way out and shot him to death, which i hope he has nightmares over the rest of his life.

Linda, your ignorance is absolutely amazing. You have a career criminal who had a weapon on him. It doesn't matter whether it was pointed at him or not. The fact is the piece of garbage was told to put the weapon down, he didn't so the officers training kicked in and he did what was necessary to prevent injuries or worse to him or any innocent bystanders. To say he should have used mace or a taser or shoot in the shoulder or leg is ignorant as well. Leg, shoulder, arm are difficult to hit, what if he shoots and misses? He could hit someone else or the piece of garbage could return fire. They are trained to shoot the biggest target, torso. Your dumbest comment in that idiotic post was that he took the cowards way out. It's real easy to make the call from the cheap seats. Walk in their shoes for one day and see the BS they have to put up with.
It's people like you that want to hold a criminals hand and give them a slap on the wrist when they do something wrong. This guy got what he deserved and the officer should hold his head high for doing the right thing and protecting the public which includes you. Next time you're in trouble and need help don't call the police Linda, get your mace and take care of the problem yourself.

Maybe I am ignorant but don't you think that the cop may have had other options. We weren't there, maybe he was really drunk, and didn't even realize what the cop was saying. he may have had the gun stuck in his pants, the cop saw it and started shaking in his pants, so his first thought was shoot to kill. the cops do have vest to protect themself, plus other equipment. They are well trained in shooting, there was no way he would have missed the arm or leg, He was just playing hero for the on lookers. No matter what the guys past was he didn't deserve this. If he had pulled the gun on the coward it would be a different story. The cop just shot and killed a defensless drunk, the poor guy wasn't able to defend himself even speak for himself.
I would not give a criminal a slap on the hand, I believe if you do the crime you have to do the time. He did wrong and he did his time. But ignorant people like you don't understand that. You don't what his life was like or what caused him to do the things he did. Do you know why he drank to much that night, do you know why he had the gun? People like him have mental problems and need help. its a damn shame that he will never get it now.
You hear it almost everyday where a cop has shot someone, and yes they get away with murder, is this fair ? They let the power of their badges go to there head and use this power to do what the hell they want. I agree they have to protect themself, but I don't think deadly force is always the answer.

Maybe the man didn't deserve to be killed, but I must be an ignorant one too, because a repeat offender who has already been to jail on the occasion of threatening to kill and weapons charges was again with a weapon. This time it was concealed, which is illegal in NJ to do so and even if you were allowed to conceal, like many other states it is illegal to conceal carry in a bar if you are drinking. A law abiding citizen would 1. not conceal their weapon, 2. would obey the officer. Regardless whether or not the officer is right or wrong, they a charged with protecting citizens, enforcing laws, and keeping the peace, so they have the authority to ask questions and tell you to do something. Is it really that hard to follow directions? No, its not, if you do what's asked and it should only take a few minutes of your time. A normal person would learn from their mistakes after being punished the first time.

Just so you uneducated people know, the use of a firearm by a police officer is considered deadly force. If the officer discharges his weapon then he felt that others or himself were in danger for their lives. Under nj law you are not allowed to discharge your weapon just to injure or for any warning shots. So basically if he discharges the weapon ot is the eliminate the threat. Its funny because all the people saying the cop was wrong would be crying a different story if the drunk susp turned and shot somebody they knew at the bar. How would yhey like it if the cops and pros said " susp was drunk and did not know what was going on, we thought he was too drunk too actually hit someone". Good job sgt, you had no other choice

Bojangles is right like I said in my first comment look at the facts. The man has a history of crime, the man was drunk, the man was armed with a gun! I am an Infantryman in the U.S. Army and let me tell you "Linda" it is not easy to simply shoot an arm or a leg, especially in the heat of the moment when it's go-time. This Officer both protected and served the public. He gave a clear warning to the threat, the criminal, and the man did not respond. After that not only is he in the right to engage the threat, it would have been wrong of him not to. He took one shot to the torso, the area that both police and armed forces are trained to shoot at first because it minimizes chance of missing the shot. The officer did a great job, he should be rewarded by all of us not badgered. Great work officer you made our streets a little safer, keep it up.

Another piece of garbage is off the streets and we have the brave officer to thank. He did the right thing and as a community we should stand behind him and his actions. I'm tired of paying for these creatures to rot in jail. As a taxpayer, I don't want to provide three hots and a cot for criminals - if they are proven guilty, they need to be put out of their misery. Thomas, little did this story leave out, that Mark suffered Mental illness And he heard voices, as well as, just released from Shore Behavior Health Hospital the night before the shooting. And the law knows all about his mental illness. So, calling someone ignorant, when you pass judgement on someone you did not even know does not say much for yourself. And LINDA, you are spot on! ;)
