Freeholder's Daughter Did Not Receive Special Treatment In Little Egg Thefts, State Says
Dawn Marie Kelly had no prior criminal record, pleaded guilty to accusation of stealing $40,000 from tax collector's office
The theft of $40,000 from the Little Egg Harbor tax collector's office first came to light when some residents received notices they had not paid their taxes when they had.
Little Egg Harbor officials then discovered that Dawn Marie Kelly, the 30-year-old daughter of Freeholder Director John P. Kelly, had been pocketing tax payment paid in cash, said Peter Aseltine, a spokesman for the state Attorney General's office.
"They paid and the money disappeared," he said. "That led to the tax collector contacting Little Egg Harbor police, who referred it to the Division of Criminal Justice and the State Police."
Dawn Kelly, who worked as the deputy tax collector, pleaded guilty to an accusation of theft by unlawful taking prior to being indicted, he said.
"We made it clear she would be charged, she would be indicted," Aseltine said.
The state Attorney General's office agreed to the plea with no jail time, as long as Kelly agreed to resign, enter a long-term, inpatient drug treatment program, and pay back the money, he said.
Pleading guilty to a third degree time without any prior criminal history comes with a presumption of no jail time, according to state sentencing guidelines, Aseltine said.
"This was a fairly typical resolution in this kind of a case," he said. "We feel it's an appropriate resolution and it's in keeping with the nature of the case."
Kelly also agreed to pay back the $40,000 in restitution, give up her job and will never be able to hold a public position again, said Aseltine.
She still owes $6,486 in restitution. The balance has already been paid. Aseltine said he did not know how the balance was paid.
"I don't have specific information on the source of the funds that was paid back by her," he said.
Aseltine also said he did not know who would pay for the drug treatment program.
Kelly, Eagleswood Township, pleaded guilty to on Dec. 14 before Ocean County Superior Court Judge James M. Blaney.
The thefts took place between Nov. 11, 2011 and July 31, 2012, the state Attorney General's Office has said.
The Ocean County Prosecutor's Office also referred the matter to the state Attorney General's Office because of potential conflicts of interest, Executive Assistant Prosecutor Michel A. Paulhus has said.

Not only did you not read the article carefully, you know nothing about the legal system. Is she supposed to be treated MORE harshly because she's a freeholder's daughter? Sentences are prescribed by the statutes and judges have limited discretion. The taxpayers are not going to be double billed - that's ridiculous and you know it. I don't know this person but it appears she's being treated like any other drug addicted nonviolent first time offender.

If you read the first paragraph of the story you learn that $40,000. was stolen. If by some reason this theft was not discovered, who thinks that she would have given back the money?
The money WAS stolen. She gave it back because she HAD to give the money back. If she had gotten wawy with it, she would not have given the money back. Plain & simple...she is a thief, who stole $40,000. of TAXPAYERS money.

So this all seems to come down to the judges opinion and decision of a plea of third degree. Did the judge exercise impartiality without out influence and a phone call from Jack, George, Starkey or Mr. Chris himself? Understanding the law with first offenders, OK, but who decided the title /type of charge for Ms. Kelly. Seems that is the issue here - a charge of illegality with the most possible leniency. Like said, most anyone else would be in jail. This is what happens when you have a small group of "thugs" running your county. The FBI will only go after acts involving 500k or more. Less than that goes to the NJ AG's office and down the chain after that. As far as the rumors of more sealed indictments pending, I doubt it. Maybe some ongoing investigations on lesser allegations, eyes and ears, looking for Mr Big

The former finance officer of the Ocean County library has been sentenced to three years in state prison for official misconduct for stealing $5,000 in book fines and copier fees from the library, authorities said.
Jill Fisher, a former 16-year-employee of the library, repaid $20,000 - representing the amount she admitted stealing plus the cost of an audit - before Superior Court Judge Barbara Ann Villano sentenced her to prison Nov. 14, said Assistant Ocean County Prosecutor Martin Anton.
Fisher, 40, of Manchester, was arrested in October 2007 following an investigation by the Ocean County Prosecutor's Internal Affairs/Corruption Unit.
She subsequently pleaded guilty to official misconduct and agreed to forfeit her job and pension, Anton said.
Fisher could have faced up to 10 years in prison for the offense.

Interesting reference to previous precedence and it seems like the current sentence and reparations are not similar. It certainly is suggestive of preferential treatment - mitigation may be the drug problem. How did she qualify for the deputy tax collector job in the first place?

This was a coverup. What government worker can steal over $40K and not be charged with misconduct in office? Someone said the presumption for a 3rd degree crime for a first offender is probation. How about the presumption for a first offender for misconduct in office is five years. Why was she not charged?
